Trilogie CRE were appointed to negotiate a dilapidations claim that was served on their client by the Landlord following the service of a lease break notice. The total claim was approximately £1.1m.
To comply with the condition of the break notice full vacant possession had to be provided and the demise returned in full repair and good decorative order by the break date. The vacation was phased to accommodate business operations and minimise disruption.
Part of the 2nd Floor was sub-let, which included separate negotiations.
A detailed review of all lease documents was undertaken and strategic advice was provided.
A specification of works was prepared and contractor’s competitive tender prices obtained. Unable to agree a monetary settlement with the Landlord, a contract was placed and the works were procured under a JCT Form of Contract.
The works were completed satisfying all dilapidations obligations and in turn we achieved a saving of approximately 60% compared to the Landlord’s original claim.
